Terms & Conditions

These General Terms & Conditions apply to all guests staying in Arcade Hotel Athens.

 

1. DEFINITIONS

Hotel (or "we"): The hotel unit (Arcade Hotel Athens), which provides you with accommodation services.

Customer: the person who requests the services of Arcade Hotel Athens.

Guest (or "you"): the Customer and the other persons who will stay in the room or rooms of our Arcade Hotel Athens specified by the Customer.

Contract: the agreement between the Hotel on the one hand and the Customer and Visitors on the other for the provision of accommodation and other related services and facilities during your stay at the Hotel, excluding third party services. The Agreement includes the said General Terms and Conditions, the Personal Data Protection Statement as well as the Privacy Policy.

Third Parties: independent companies and contractors to whom Arcade Hotel Athens grants the right to independently provide services to our Guests, called Third Party Services.

Third Party Services: the services provided by Third Parties, such as indicative tours, guided tours, vehicle rental, transfer or taxi services, sports as well as other services charged directly by Third Parties or indirectly by the Hotel and provided by an independent company or an independent person, not employed by the Hotel.

Booking Agents: travel agencies, travel agents or any other third party who, either directly or through an online platform or other online medium, telephone or otherwise, arranges a booking with Arcade Hotel Athens so that you can receive accommodation services from us.

Booking Confirmation: the acceptance of the Customer's request by the Hotel, which includes pricing, arrival and departure dates, number of guests, number of rooms and other facilities provided to the Customers and accompanying Guests.

2. SERVICES

Arcade Hotel Athens provides services as described on our official website and in said General Terms and Conditions, such as accommodation services. 

3. RESERVATION

3.1. Anyone can make a reservation, either directly with Arcade Hotel Athens, through our website, through Online Travel Agents (OTAs), or through Booking Agents. In the event that the Customer makes a reservation through a Booking Agent, Arcade Hotel Athens is not responsible for services promised by such Booking Agent, if such services are not included on the official Arcade Hotel Athens website or for terms and prices that the such Booking Agent was not authorized to provide you.

3.2. To complete a reservation at Arcade Hotel Athens you must be over 18 years old. If you are a minor, your parents can make the reservation on your behalf. In this case, your parents or an adult should accompany you during your stay at our hotel. In any case, if the reservation is made using a valid credit or debit card, the owner of the card must be with you.

3.3. The Customer is responsible for providing their personal details, as requested during the booking process, which should be true and accurate and as shown on the Customer's ID or passport. In addition, the Customer is required to keep their details up to date as required to enable us to provide them with our services and to perform this Agreement. The Hotel is not obliged to inform the Customer regarding this Agreement if the Customer's personal contact information is false, misleading or no longer valid and therefore communication with the Customer is impossible, in which case the Customer agrees to waive his right to information.

3.4. Reservation of a specific room in any hotel is not possible, unless this is expressly stated in the Booking Confirmation. The customer may book a specific room type from a list of specific room types as displayed on the Arcade Hotel Athens official website.

3.5. The booking request is reviewed and if approved, you will receive a Booking Confirmation from Arcade Hotel Athens. In case you book through a Booking Agent, you will receive a booking confirmation from the Booking Agent. Arcade Hotel Athens is not obliged to provide you with accommodation services if you have not received a Booking Confirmation.

4. PAYMENT TERMS & CANCELLATION POLICY

4.1. You can pay for your stay at Arcade Hotel Athens by all available methods such as cash, credit card, electronic payment, money transfer or any other method accepted by us in the future. The payment policy is as follows:

For Non-Refundable Rate bookings, the full amount will be charged to your credit card at the time of booking and will not be refunded in the event of a cancellation, amendment or no-show.

For Flexible Bookings, a 25% prepayment is required to secure your booking. The Hotel reserves the right to keep the prepayment in case the Guest cancels within 10 days before check-in day. Our payment policy is available on our website and will also be provided during the booking process in respect of your particular order placed through our online tools and platform or through the Booking Agents or their own platforms. A specific payment policy is provided in the Customer's Booking Confirmation.

4.2. In case of payment by credit card, the Hotel has the right to ask you to show your credit card at the reception upon your arrival. If you refuse to show your credit card or if the name written on it is not the same as the Customer's, then the Hotel may immediately cancel the Booking Confirmation and refuse to provide accommodation services to you and your Guests. In this case, you can pay in cash and the Hotel will not cancel your Booking Confirmation. In the event that the name on the credit card is different from the name of the Customer and the credit card holder is present and agrees to become the Customer himself, then the Hotel will provide accommodation services,

4.3. In order to provide you with a Booking Confirmation, Arcade Hotel Athens will usually ask you to pay a deposit to the Hotel's account or charge your credit card on behalf of the Hotel. If your booking is made through a Booking Agent, the deposit amount will be included in the Booking Agent's payment slip. In the event that you do not appear at the Hotel on the date of arrival as stated in the Booking Confirmation and do not use the accommodation services or do not inform us of the above, then the Hotel will keep the aforementioned advance payments as compensation and may offer the room or the rooms he had reserved for the Customer to third parties.

4.4. The cancellation policy is as follows:

For Non-Refundable Rate bookings, free cancellation is not allowed. If the reservation is canceled or modified or in case the Customer and Guests do not show up, an amount equal to 100% of the price of the reservation will be charged as a cancellation fee.

For Flexible Bookings, cancellation policies may vary, depending on the Hotel's policy and the dates of your booking.

Our cancellation policy is available on our website. The specific cancellation policy for approved products and services is included in the Customer's Booking Confirmation. For Flexible Reservations, if the aforementioned documents do not mention our cancellation policy, the Hotel has the right to keep the deposit if you do not notify us of the cancellation of your reservation at least 21 days before your arrival date (check- in), as stated in your Booking Confirmation.

4.5. In case you wish to change your reservation or the dates of arrival and departure (check in & check out), you must send your request to the Hotel. The Hotel is not obligated to accept your request, the approval of which depends on hotel availability, original reservation dates and other factors. In addition, you may incur additional charges, of which you will be notified. In the event that the Hotel accepts your request and you approve any additional charges incurred, you will receive an updated Booking Confirmation. On behalf of the Hotel, only the updated Booking Confirmation can be considered valid approval for the change in your booking or for the change in your arrival and departure date.

4.6. The Customer is obliged to pay the Accommodation Tax imposed by the Greek Government. The Accommodation Tax is paid by guests upon arrival and is based on the official classification of accommodation, as follows:

5-star hotels: 4€ per room per night

4-star hotels: €3€ per room per night

3-star hotels: 1,5€ per room per night

1-2 star hotels: 0,5€ per room per night

Payment can be made by cash or credit card.

4.7. Any other charge for additional services provided during the Guest's stay will be paid immediately or charged to the account of each room. The Customer must pay the bills in full for each room booked before departure. The Hotel must provide the Customer with the relevant invoice that will include in detail the corresponding charges.

5. YOUR STAY AT ARCADE HOTEL ATHENS

5.1. Check in & check out times are stated on our website and in the Booking Confirmation. In case there is no relevant reference in these documents, then Customers and Visitors can check in between 14:00-23:00 and check out until 11:00.

5.2. The Hotel is not obliged to provide accommodation to the Client and Guests before 14:00 (first check in) In case the Client has a different agreement with the Hotel, an additional fee may be applied. If the Customer accepts this charge, then the Hotel will send an amended Booking Confirmation. Any deviation from the aforementioned check-in & check-out times can only be binding for the Hotel if, a) so defined in the Booking Confirmation or b) there is a corresponding request during the Guests' stay, and after the Hotel Manager has given approval of and the Customer has paid the additional charge amount.

5.3. In the event that the Customer and his Guests do not leave their room or rooms by 12:00 on the day of their departure (late check out), the Hotel has the right to apply an additional fee, depending on the time which the Customer and the Guests finally left the room or rooms. If the Client and his Guests leave the room before 18:00 on the day of their departure, then the Client is obliged to pay an amount equal to 50% of the room price for that day. If the Client and their Guests check out of the room after 18:00 on the day of their departure, then the Client must pay 100% of the room rate for that day.

6. LOST, VALUABLES & OTHER ITEMS

In the event that you lose items, valuables or anything in your possession during your stay at our hotel, you should immediately inform the Hotel reception. For the convenience of our Visitors, all lost, valuables or other found items are kept for one (1) week from the date they were found. In case we find objects and valuables, we are not obliged to contact our Visitors to inform them about this. If we are not notified by our Guests that they have lost specific items, valuables or other property within one (1) week of their departure (check out date), our hotel will have no obligation to return them, as it is our policy to dispose of any lost items, valuables and others found in our hotel after one (1) week. If lost, valuables or other items are returned to you, shipping or courier costs will be borne by you, prior to shipping.

7. STOLEN ITEMS, VALUABLES & OTHER PROPERTY

The Hotel bears no responsibility for any items, valuables or other property of our Guests that have been stolen. It is your responsibility to protect your property and keep your valuables safe. Our Guests must inform the Hotel reception immediately, in case of theft of objects, property or other valuables, so that the police can be notified as soon as possible.

8. MATERIAL DAMAGE TO THE HOTEL

Our Guests are responsible for any damage caused to the Hotel room or to furniture and equipment therein, as well as to the hotel unit due to any act or omission attributable to them or their guests. In this case, the Customer is liable for the damages jointly with the Visitors and their invitees. If material damage is detected after the Guests' departure, our hotel reserves the right to charge the Customer's credit or debit card. In this case, our hotel reserves the right to charge the Customer the replacement cost of any items destroyed or removed by the Customer, Guests or their invitees without the Hotel's consent.

9. HOTEL OBLIGATIONS

9.1. The Hotel is responsible for providing accommodation services to the Guests of the Hotel as stated on its website and in the Booking Confirmation, with due diligence and professionalism, demonstrating the necessary responsibility, as expected from any hotel around the world. The Hotel applies a strict and high-quality health and safety policy, especially in relation to the food and drink available at the Hotel. Arcade Hotel Athens complies with all the mandatory provisions of the regulations and legislation for hygiene and safety in Greece.

9.2. Arcade Hotel Athens cooperates with external hospitals and doctors. In case of injury, illness or need for medical attention, our Guests can notify the Hotel reception immediately so that we can ask for help from our external partners. The Hotel bears no responsibility for the services or charges of external hospitals or doctors, which the Guests must pay directly as they are not included in our charges.

10. VISITORS' OBLIGATIONS

10.1. Guests should behave themselves and have good manners during their stay at Arcade Hotel Athens. Guests must not behave inappropriately, make noises that disturb other guests, do any damage, cause injury or offend third parties, whether employees of the Hotel or other guests of the Hotel. The Hotel may deny access to its facilities, rooms or unit to Guests who do not comply with the aforementioned rules, as well as those who do not follow appropriate hygiene standards or have consumed amounts of alcohol that lead to inappropriate behavior. In the event of death, injury or other damage for which specific Guests are responsible, the Hotel may provide their personal information to the police for the initiation of relevant prosecution procedures. They themselves will be responsible for indemnifying the Hotel and will disclaim any responsibility of the Hotel towards claims and lawsuits of third parties or employees caused due to their actions, as well as those who do not follow appropriate hygiene standards or have consumed amounts of alcohol that lead to inappropriate behavior. 

10.2. Arcade Hotel Athens does not allow children under the age of 18 to enter. You will be informed of this during your booking. You can be accompanied by your children under the age of 18 only if they have been included in your Booking Confirmation.

10.3. Animals or pets are not allowed in Arcade Hotel Athens. In some cases, we may allow the entry of service dogs or other deviations from this policy, provided that there has been a corresponding request to the Hotel, which has been approved by us and is included in the Booking Confirmation.

10.4. Smoking is strictly prohibited inside the Hotel, including all rooms, common areas, elevators, corridors, lobby and breakfast area. While in an open area outside the Hotel or on the balconies, our Guests are advised to avoid smoking near other guests, in a way that disrupts their stay and their ability to enjoy our facilities and services.

10.5. Arcade Hotel Athens does not provide parking for Guests' vehicles. In case the Hotel has a parking space, it is agreed that the Hotel bears no responsibility for the safety of the Visitors' vehicles and that the Visitors will have insurance coverage to cover any damage, destruction or theft.

10.6. You can consume drinks and food available in the minibar in your room. In this case, your room will be charged for each item consumed. In your room you can find a price list for the products in the minibar as well as other useful information about room service. For special requests you can notify the hotel's room service or reception.

10.7. Guests are not allowed to bring their own food and drinks to the Hotel. In the event of illness, poisoning, salmonella or other illness caused by food or drink that you brought to the Hotel, you are responsible for immediately informing the Hotel reception and for disclaiming the Hotel's liability against any third party claim for damages caused by illnesses that transmitted to other guests or employees of the Hotel.

10.8. You may not sublet the room provided to you by the Hotel or provide accommodation in this room to third parties. Upon your arrival you are required to declare the exact number of guests who will be staying in the rooms you have reserved. No additional guests are allowed unless approved by the Hotel manager, in which case additional charges may apply.

10.9. In the event that a Guest has a physical or mental disability, the Customer must inform the Hotel before the Booking Confirmation or at least five (5) working days before check-in. If the Hotel is not informed that a Guest has a physical disability, then the Hotel bears no responsibility to the Customer or said Guest, if they are unable to make partial or full use of the hotel facilities or proper use of the hotel facilities services and the Customer will be required to pay the full amount applicable to their reservation. Visitors with an intellectual disability must be accompanied by a professional paramedic or doctor who will be able to provide the necessary treatment, if needed,

10.10. Arcade Hotel Athens provides free Wi-Fi access. You are obliged to comply with its correct use policy. For example, you may not use these services for illegal or fraudulent acts, defamation, insults to third parties, infringement of intellectual property rights, or to engage in acts that would result in a denial of service. In addition, Visitors are required to respect privacy and comply with all such legislation, regulations and guidelines for the protection of their personal data when using wireless network (wi-fi) services. The Hotel may temporarily or permanently suspend the provision of wireless network (wi-fi) services to Guests who do not comply with their legal obligations or with the Hotel's appropriate wi-fi usage policy, without further notice. In this case, the Guest can contact the Hotel reception and the wireless network (wi-fi) services will be restored after the request is first approved by the Hotel manager. The Hotel may also temporarily suspend the provision of wireless network services (wi-fi) in order to maintain, support or upgrade its systems, in which case the Hotel shall not be liable to the Guests for the lack of availability of wireless network services (wi- fi),

10.11. In case of complaints, we encourage you to inform the Hotel manager or reception during your stay. Otherwise, there is a possibility that the Hotel will not consider your complaint if it is submitted after your departure. In any case, the Hotel is not obliged to examine or respond to any complaint submitted one (1) month after the Guest's departure. In this case you waive your rights to submit complaints to any competent administrative authority or Court.

11. CANCELLATION BY THE HOTEL

The Hotel may cancel any Booking Confirmation or any booking, at any time and without having to compensate the Customer or Guests. For example, the Hotel may cancel any reservation in the event that:

11.1. The Customer has provided incorrect or misleading information regarding their personal information and contact details.

11.2. The Customer and its Visitors violate any provision of this Agreement, all of which shall be deemed material.

11.3. The Hotel has reasonable grounds to assume that the use of accommodation services may endanger the operation of the hotel, the security or the image of the hotel to the public without this being attributable to the Hotel itself and/or its company.

In all the above cases, the Hotel has the right to keep the deposit deposited by the Customer as compensation.

12. RELATIONSHIP WITH BOOKING AGENTS

Arcade Hotel Athens cooperates with Booking Agents in order to promote their accommodation services and increase the number of bookings in their hotels. However, Arcade Hotel Athens and Booking Agents are independent external partners. In this context, we enter into agreements with the Booking Agents, but we cannot be bound by their promises that are inconsistent with the services available on our website or deviate significantly from our capabilities and prices. In this context, if third parties have promised products or services that are not mentioned on our official website or prices that are not included in our agreements, we bear no responsibility for the falsification of information or false promises of the Booking Agents.

13. THIRD PARTY SERVICES

Arcade Hotel Athens allows Third Parties to provide services to our Guests, such as e.g. activities, sports, excursions, guided tours, transport and other related services. Such Third-Party Services are charged additionally by the Third Parties, either directly or, in certain cases, charged by the Hotel on behalf of the Third Parties. Arcade Hotel Athens does not control the Third Parties, which are independent companies, nor can we impose specific policies and obligations on them. However, we encourage them to have valid insurance policies in place and appropriate security policies in place. Our Visitors may use such third party services at their own free will, choice and responsibility.

14. PRIVACY AND PERSONAL DATA

We collect, use, share, store and process your personal data for many reasons, in accordance with the instructions of Greek Law and the Police, so that we can provide accommodation and other services and charge fees. With your consent, we may also collect, use, share, store and process your personal data regarding your preferences, choices, behavior, comments and suggestions in order to provide you with improved and personalized services, as well as to provide you with newsletters, advertisements and other promotional materials, special offers, to send you relevant messages or to conduct customer satisfaction surveys. 

15. LIMITATION OF LIABILITY

15.1. Except as expressly stated in the Agreement, Arcade Hotel Athens disclaim any representation or warranty, express or implied, statutory or otherwise, including without limitation, warranties of merchantability, fitness for a particular purpose or other warranties arising from performance of the agreement.

15.2. The responsibility of the Hotel is defined and subject to the terms and conditions included in the Agreement. In any case, the Hotel shall under no circumstances be liable to the Client and the Guests for indirect, consequential, special, incidental or punitive damages, including loss of income or opportunity. Based on this Agreement, the Hotel's liability is limited to the amounts paid by the Customer for accommodation services during their stay, when the specific event took place.

15.3. In the event of proven damage, injury or damage suffered by any Guest due to an intentional or deliberate act of the Hotel or its employees or due to the gross negligence of the aforementioned, the Hotel may be held liable by the competent courts to compensate the Guest. In this case, the Hotel's liability cannot exceed the amount of one thousand euros (1.000€) as full compensation for any or all damages caused to the Guest.

15.4. In the event of any complaint, damage or injury or any other type of claim against the Hotel, the Guest must notify the Hotel as soon as possible and in no case later than one (1) week after the Guest's departure from the Hotel or from the appearance of the event that gave rise to the claim or complaint. After the end of this period, the Hotel bears no responsibility towards its Guest and is released from any such responsibility and the Guest waives its right to submit any claim or initiate any administrative or judicial process against the Arcade Hotel Athens.

16. FORCE MAJEURE

16.1. "Force Majeure Event" means war or terrorist act (including cyber attack), riot, civil unrest, nuclear accident or natural disaster (such as flood, storm, extreme weather, earthquake or lightning), strike, government action, fire or serious explosion, malicious attack, disease, pandemic or any other situation beyond the control of Arcade Hotel Athens.

16.2. If the operation of any accommodation or other service provided by the Hotel is prevented or its obligations cannot be fulfilled due to any reason or any combination of Force Majeure Events, the Hotel reserves the right, at its sole option or option, to either cancel the Booking Confirmation and return the deposit to the Customer or allow the Customer to change the date of his reservation to a later time, after the approval of the Hotel, provided that in both cases the Customer is notified within a reasonable time of the appearance and nature of the Force Majeure Event.

16.3. In addition, the Hotel reserves the right at its sole option or discretion to either cancel the Booking Confirmation and return the deposit to the Customer or provide the Customer with the opportunity to change the date of their reservation at a later time, upon approval by the Hotel, in the following cases where:

All or a significant part of the Hotel facilities, where the rooms booked are located, must undergo urgent or mandatory maintenance or

There is an inability to supply natural gas, electricity, water or electronic communications to the Hotel which is not within the control of the Hotel or

It is deemed necessary to prevent or limit a pandemic or the spread of any other disease or any other threat to health and safety.

17. GENERAL PROVISIONS

17.1. The Customer and Guests may not assign or transfer any right or obligation to third parties under the Booking Confirmation, in whole or in part, without the prior written consent of the Hotel.

17.2. No waiver by Arcade Hotel Athens of a breach of any provision of such Agreement shall constitute a waiver of any other breach of such or any other provision of the Booking Confirmation. Except as otherwise provided in this Agreement, no failure to exercise or delay in exercising any right, remedy, power or privilege under this Agreement by Arcade Hotel Athens shall operate or be construed as a waiver thereof. Accordingly, no single or partial exercise of any right, remedy, power or privilege of Arcade Hotel Athens shall preclude any other or further exercise or exercise of any other right, remedy, power or privilege of Arcade Hotel Athens.

17.3. In the event that any of the provisions of these General Terms & Conditions is deemed to be unenforceable, invalid or illegal, the remaining provisions of said General Terms & Conditions will remain in full force and Arcade Hotel Athens must modify the unenforceable, invalid or illegal provisions in order to be valid, legal and enforceable.

17.4. No revision, amendment or withdrawal, termination or non-performance of this Agreement shall be effective without prior written approval by Arcade Hotel Athens. These General Terms & Conditions may be subject to modification from time to time. In that case, the revised version will be published here on our official website.

17.5. This Agreement shall be governed by, construed and enforced in accordance with the Laws of Greece, without regard to any conflicts of law provisions or principles. Any dispute arising out of or in connection with this Agreement, its interpretation, execution or validity, shall be subject to the sole and exclusive jurisdiction of the competent judicial authorities of Athens, Greece.

Our payment policy is available on our website and will also be provided during the booking process in respect of your particular order placed through our online tools and platform or through the Booking Agents or their own platforms. A specific payment policy is provided in the Customer's Booking Confirmation.

4.2. In case of payment by credit card, the Hotel has the right to ask you to show your credit card at the reception upon your arrival. If you refuse to show your credit card or if the name written on it is not the same as the Customer's, then the Hotel may immediately cancel the Booking Confirmation and refuse to provide accommodation services to you and your Guests. In this case, you can pay in cash and the Hotel will not cancel your Booking Confirmation. In the event that the name on the credit card is different from the name of the Customer and the credit card holder is present and agrees to become the Customer himself, then the Hotel will provide accommodation services,

4.3. In order to provide you with a Booking Confirmation, Arcade Hotel Athens will usually ask you to pay a deposit to the Hotel's account or charge your credit card on behalf of the Hotel. If your booking is made through a Booking Agent, the deposit amount will be included in the Booking Agent's payment slip. In the event that you do not appear at the Hotel on the date of arrival as stated in the Booking Confirmation and do not use the accommodation services or do not inform us of the above, then the Hotel will keep the aforementioned advance payments as compensation and may offer the room or the rooms he had reserved for the Customer to third parties.

4.4. The cancellation policy is as follows:

For Non-Refundable Rate bookings, free cancellation is not allowed. If the reservation is canceled or modified or in case the Customer and Guests do not show up, an amount equal to 100% of the price of the reservation will be charged as a cancellation fee.

For Flexible Bookings, cancellation policies may vary, depending on the Hotel's policy and the dates of your booking.

Our cancellation policy is available on our website. The specific cancellation policy for approved products and services is included in the Customer's Booking Confirmation. For Flexible Reservations, if the aforementioned documents do not mention our cancellation policy, the Hotel has the right to keep the deposit if you do not notify us of the cancellation of your reservation at least 21 days before your arrival date (check- in), as stated in your Booking Confirmation.

4.5. In case you wish to change your reservation or the dates of arrival and departure (check in & check out), you must send your request to the Hotel. The Hotel is not obligated to accept your request, the approval of which depends on hotel availability, original reservation dates and other factors. In addition, you may incur additional charges, of which you will be notified. In the event that the Hotel accepts your request and you approve any additional charges incurred, you will receive an updated Booking Confirmation. On behalf of the Hotel, only the updated Booking Confirmation can be considered valid approval for the change in your booking or for the change in your arrival and departure date.

4.6. The Customer is obliged to pay the Accommodation Tax imposed by the Greek Government. The Accommodation Tax is paid by guests upon arrival and is based on the official classification of accommodation, as follows:

5-star hotels: 4€ per room per night

4-star hotels: €3€ per room per night

3-star hotels: 1,5€ per room per night

1-2 star hotels: 0,5€ per room per night

Payment can be made by cash or credit card.

4.7. Any other charge for additional services provided during the Guest's stay will be paid immediately or charged to the account of each room. The Customer must pay the bills in full for each room booked before departure. The Hotel must provide the Customer with the relevant invoice that will include in detail the corresponding charges.

5. YOUR STAY AT ARCADE HOTEL ATHENS

5.1. Check in & check out times are stated on our website and in the Booking Confirmation. In case there is no relevant reference in these documents, then Customers and Visitors can check in between 14:00-23:00 and check out until 11:00.

5.2. The Hotel is not obliged to provide accommodation to the Client and Guests before 14:00 (first check in) In case the Client has a different agreement with the Hotel, an additional fee may be applied. If the Customer accepts this charge, then the Hotel will send an amended Booking Confirmation. Any deviation from the aforementioned check-in & check-out times can only be binding for the Hotel if, a) so defined in the Booking Confirmation or b) there is a corresponding request during the Guests' stay, and after the Hotel Manager has given approval of and the Customer has paid the additional charge amount.

5.3. In the event that the Customer and his Guests do not leave their room or rooms by 12:00 on the day of their departure (late check out), the Hotel has the right to apply an additional fee, depending on the time which the Customer and the Guests finally left the room or rooms. If the Client and his Guests leave the room before 18:00 on the day of their departure, then the Client is obliged to pay an amount equal to 50% of the room price for that day. If the Client and their Guests check out of the room after 18:00 on the day of their departure, then the Client must pay 100% of the room rate for that day.

6. LOST, VALUABLES & OTHER ITEMS

In the event that you lose items, valuables or anything in your possession during your stay at our hotel, you should immediately inform the Hotel reception. For the convenience of our Visitors, all lost, valuables or other found items are kept for one (1) week from the date they were found. In case we find objects and valuables, we are not obliged to contact our Visitors to inform them about this. If we are not notified by our Guests that they have lost specific items, valuables or other property within one (1) week of their departure (check out date), our hotel will have no obligation to return them, as it is our policy to dispose of any lost items, valuables and others found in our hotel after one (1) week. If lost, valuables or other items are returned to you, shipping or courier costs will be borne by you, prior to shipping.

7. STOLEN ITEMS, VALUABLES & OTHER PROPERTY

The Hotel bears no responsibility for any items, valuables or other property of our Guests that have been stolen. It is your responsibility to protect your property and keep your valuables safe. Our Guests must inform the Hotel reception immediately, in case of theft of objects, property or other valuables, so that the police can be notified as soon as possible.

8. MATERIAL DAMAGE TO THE HOTEL

Our Guests are responsible for any damage caused to the Hotel room or to furniture and equipment therein, as well as to the hotel unit due to any act or omission attributable to them or their guests. In this case, the Customer is liable for the damages jointly with the Visitors and their invitees. If material damage is detected after the Guests' departure, our hotel reserves the right to charge the Customer's credit or debit card. In this case, our hotel reserves the right to charge the Customer the replacement cost of any items destroyed or removed by the Customer, Guests or their invitees without the Hotel's consent.

9. HOTEL OBLIGATIONS

9.1. The Hotel is responsible for providing accommodation services to the Guests of the Hotel as stated on its website and in the Booking Confirmation, with due diligence and professionalism, demonstrating the necessary responsibility, as expected from any hotel around the world. The Hotel applies a strict and high-quality health and safety policy, especially in relation to the food and drink available at the Hotel. Arcade Hotel Athens complies with all the mandatory provisions of the regulations and legislation for hygiene and safety in Greece.

9.2. Arcade Hotel Athens cooperates with external hospitals and doctors. In case of injury, illness or need for medical attention, our Guests can notify the Hotel reception immediately so that we can ask for help from our external partners. The Hotel bears no responsibility for the services or charges of external hospitals or doctors, which the Guests must pay directly as they are not included in our charges.

10. VISITORS' OBLIGATIONS

10.1. Guests should behave themselves and have good manners during their stay at Arcade Hotel Athens. Guests must not behave inappropriately, make noises that disturb other guests, do any damage, cause injury or offend third parties, whether employees of the Hotel or other guests of the Hotel. The Hotel may deny access to its facilities, rooms or unit to Guests who do not comply with the aforementioned rules, as well as those who do not follow appropriate hygiene standards or have consumed amounts of alcohol that lead to inappropriate behavior. In the event of death, injury or other damage for which specific Guests are responsible, the Hotel may provide their personal information to the police for the initiation of relevant prosecution procedures. They themselves will be responsible for indemnifying the Hotel and will disclaim any responsibility of the Hotel towards claims and lawsuits of third parties or employees caused due to their actions, as well as those who do not follow appropriate hygiene standards or have consumed amounts of alcohol that lead to inappropriate behavior. 

10.2. Arcade Hotel Athens does not allow children under the age of 18 to enter. You will be informed of this during your booking. You can be accompanied by your children under the age of 18 only if they have been included in your Booking Confirmation.

10.3. Animals or pets are not allowed in Arcade Hotel Athens. In some cases, we may allow the entry of service dogs or other deviations from this policy, provided that there has been a corresponding request to the Hotel, which has been approved by us and is included in the Booking Confirmation.

10.4. Smoking is strictly prohibited inside the Hotel, including all rooms, common areas, elevators, corridors, lobby and breakfast area. While in an open area outside the Hotel or on the balconies, our Guests are advised to avoid smoking near other guests, in a way that disrupts their stay and their ability to enjoy our facilities and services.

10.5. Arcade Hotel Athens does not provide parking for Guests' vehicles. In case the Hotel has a parking space, it is agreed that the Hotel bears no responsibility for the safety of the Visitors' vehicles and that the Visitors will have insurance coverage to cover any damage, destruction or theft.

10.6. You can consume drinks and food available in the minibar in your room. In this case, your room will be charged for each item consumed. In your room you can find a price list for the products in the minibar as well as other useful information about room service. For special requests you can notify the hotel's room service or reception.

10.7. Guests are not allowed to bring their own food and drinks to the Hotel. In the event of illness, poisoning, salmonella or other illness caused by food or drink that you brought to the Hotel, you are responsible for immediately informing the Hotel reception and for disclaiming the Hotel's liability against any third party claim for damages caused by illnesses that transmitted to other guests or employees of the Hotel.

10.8. You may not sublet the room provided to you by the Hotel or provide accommodation in this room to third parties. Upon your arrival you are required to declare the exact number of guests who will be staying in the rooms you have reserved. No additional guests are allowed unless approved by the Hotel manager, in which case additional charges may apply.

10.9. In the event that a Guest has a physical or mental disability, the Customer must inform the Hotel before the Booking Confirmation or at least five (5) working days before check-in. If the Hotel is not informed that a Guest has a physical disability, then the Hotel bears no responsibility to the Customer or said Guest, if they are unable to make partial or full use of the hotel facilities or proper use of the hotel facilities services and the Customer will be required to pay the full amount applicable to their reservation. Visitors with an intellectual disability must be accompanied by a professional paramedic or doctor who will be able to provide the necessary treatment, if needed,

10.10. Arcade Hotel Athens provides free Wi-Fi access. You are obliged to comply with its correct use policy. For example, you may not use these services for illegal or fraudulent acts, defamation, insults to third parties, infringement of intellectual property rights, or to engage in acts that would result in a denial of service. In addition, Visitors are required to respect privacy and comply with all such legislation, regulations and guidelines for the protection of their personal data when using wireless network (wi-fi) services. The Hotel may temporarily or permanently suspend the provision of wireless network (wi-fi) services to Guests who do not comply with their legal obligations or with the Hotel's appropriate wi-fi usage policy, without further notice. In this case, the Guest can contact the Hotel reception and the wireless network (wi-fi) services will be restored after the request is first approved by the Hotel manager. The Hotel may also temporarily suspend the provision of wireless network services (wi-fi) in order to maintain, support or upgrade its systems, in which case the Hotel shall not be liable to the Guests for the lack of availability of wireless network services (wi- fi),

10.11. In case of complaints, we encourage you to inform the Hotel manager or reception during your stay. Otherwise, there is a possibility that the Hotel will not consider your complaint if it is submitted after your departure. In any case, the Hotel is not obliged to examine or respond to any complaint submitted one (1) month after the Guest's departure. In this case you waive your rights to submit complaints to any competent administrative authority or Court.

11. CANCELLATION BY THE HOTEL

The Hotel may cancel any Booking Confirmation or any booking, at any time and without having to compensate the Customer or Guests. For example, the Hotel may cancel any reservation in the event that:

11.1. The Customer has provided incorrect or misleading information regarding their personal information and contact details.

11.2. The Customer and its Visitors violate any provision of this Agreement, all of which shall be deemed material.

11.3. The Hotel has reasonable grounds to assume that the use of accommodation services may endanger the operation of the hotel, the security or the image of the hotel to the public without this being attributable to the Hotel itself and/or its company.

In all the above cases, the Hotel has the right to keep the deposit deposited by the Customer as compensation.

12. RELATIONSHIP WITH BOOKING AGENTS

Arcade Hotel Athens cooperates with Booking Agents in order to promote their accommodation services and increase the number of bookings in their hotels. However, Arcade Hotel Athens and Booking Agents are independent external partners. In this context, we enter into agreements with the Booking Agents, but we cannot be bound by their promises that are inconsistent with the services available on our website or deviate significantly from our capabilities and prices. In this context, if third parties have promised products or services that are not mentioned on our official website or prices that are not included in our agreements, we bear no responsibility for the falsification of information or false promises of the Booking Agents.

13. THIRD PARTY SERVICES

Arcade Hotel Athens allows Third Parties to provide services to our Guests, such as e.g. activities, sports, excursions, guided tours, transport and other related services. Such Third-Party Services are charged additionally by the Third Parties, either directly or, in certain cases, charged by the Hotel on behalf of the Third Parties. Arcade Hotel Athens does not control the Third Parties, which are independent companies, nor can we impose specific policies and obligations on them. However, we encourage them to have valid insurance policies in place and appropriate security policies in place. Our Visitors may use such third party services at their own free will, choice and responsibility.

14. PRIVACY AND PERSONAL DATA

We collect, use, share, store and process your personal data for many reasons, in accordance with the instructions of Greek Law and the Police, so that we can provide accommodation and other services and charge fees. With your consent, we may also collect, use, share, store and process your personal data regarding your preferences, choices, behavior, comments and suggestions in order to provide you with improved and personalized services, as well as to provide you with newsletters, advertisements and other promotional materials, special offers, to send you relevant messages or to conduct customer satisfaction surveys. 

15. LIMITATION OF LIABILITY

15.1. Except as expressly stated in the Agreement, Arcade Hotel Athens disclaim any representation or warranty, express or implied, statutory or otherwise, including without limitation, warranties of merchantability, fitness for a particular purpose or other warranties arising from performance of the agreement.

15.2. The responsibility of the Hotel is defined and subject to the terms and conditions included in the Agreement. In any case, the Hotel shall under no circumstances be liable to the Client and the Guests for indirect, consequential, special, incidental or punitive damages, including loss of income or opportunity. Based on this Agreement, the Hotel's liability is limited to the amounts paid by the Customer for accommodation services during their stay, when the specific event took place.

15.3. In the event of proven damage, injury or damage suffered by any Guest due to an intentional or deliberate act of the Hotel or its employees or due to the gross negligence of the aforementioned, the Hotel may be held liable by the competent courts to compensate the Guest. In this case, the Hotel's liability cannot exceed the amount of one thousand euros (1.000€) as full compensation for any or all damages caused to the Guest.

15.4. In the event of any complaint, damage or injury or any other type of claim against the Hotel, the Guest must notify the Hotel as soon as possible and in no case later than one (1) week after the Guest's departure from the Hotel or from the appearance of the event that gave rise to the claim or complaint. After the end of this period, the Hotel bears no responsibility towards its Guest and is released from any such responsibility and the Guest waives its right to submit any claim or initiate any administrative or judicial process against the Arcade Hotel Athens.

16. FORCE MAJEURE

16.1. "Force Majeure Event" means war or terrorist act (including cyber attack), riot, civil unrest, nuclear accident or natural disaster (such as flood, storm, extreme weather, earthquake or lightning), strike, government action, fire or serious explosion, malicious attack, disease, pandemic or any other situation beyond the control of Arcade Hotel Athens.

16.2. If the operation of any accommodation or other service provided by the Hotel is prevented or its obligations cannot be fulfilled due to any reason or any combination of Force Majeure Events, the Hotel reserves the right, at its sole option or option, to either cancel the Booking Confirmation and return the deposit to the Customer or allow the Customer to change the date of his reservation to a later time, after the approval of the Hotel, provided that in both cases the Customer is notified within a reasonable time of the appearance and nature of the Force Majeure Event.

16.3. In addition, the Hotel reserves the right at its sole option or discretion to either cancel the Booking Confirmation and return the deposit to the Customer or provide the Customer with the opportunity to change the date of their reservation at a later time, upon approval by the Hotel, in the following cases where:

All or a significant part of the Hotel facilities, where the rooms booked are located, must undergo urgent or mandatory maintenance or

There is an inability to supply natural gas, electricity, water or electronic communications to the Hotel which is not within the control of the Hotel or

It is deemed necessary to prevent or limit a pandemic or the spread of any other disease or any other threat to health and safety.

17. GENERAL PROVISIONS

17.1. The Customer and Guests may not assign or transfer any right or obligation to third parties under the Booking Confirmation, in whole or in part, without the prior written consent of the Hotel.

17.2. No waiver by Arcade Hotel Athens of a breach of any provision of such Agreement shall constitute a waiver of any other breach of such or any other provision of the Booking Confirmation. Except as otherwise provided in this Agreement, no failure to exercise or delay in exercising any right, remedy, power or privilege under this Agreement by Arcade Hotel Athens shall operate or be construed as a waiver thereof. Accordingly, no single or partial exercise of any right, remedy, power or privilege of Arcade Hotel Athens shall preclude any other or further exercise or exercise of any other right, remedy, power or privilege of Arcade Hotel Athens.

17.3. In the event that any of the provisions of these General Terms & Conditions is deemed to be unenforceable, invalid or illegal, the remaining provisions of said General Terms & Conditions will remain in full force and Arcade Hotel Athens must modify the unenforceable, invalid or illegal provisions in order to be valid, legal and enforceable.

17.4. No revision, amendment or withdrawal, termination or non-performance of this Agreement shall be effective without prior written approval by Arcade Hotel Athens. These General Terms & Conditions may be subject to modification from time to time. In that case, the revised version will be published here on our official website.

17.5. This Agreement shall be governed by, construed and enforced in accordance with the Laws of Greece, without regard to any conflicts of law provisions or principles. Any dispute arising out of or in connection with this Agreement, its interpretation, execution or validity, shall be subject to the sole and exclusive jurisdiction of the competent judicial authorities of Athens, Greece.
